Instead, this information will be published in separate memoranda on the Import Administration’s website.

According to 77 FRN 25405, IA has determined that it will no longer publish extension notices for preliminary and final results of reviews, as there are no statutory or regulatory requirements for doing so and the financial burden outweighs the benefits associated with their publication.  It was also noted that IA will cease publishing notices of Advance Notification of Sunset Reviews as well as a list of pending scope inquiries.  All other notices will continue to be published as an FRN, but in a modified and condensed version.

Also from the FRN, “Beginning September 1, 2012, abbreviated notices for all preliminary determinations and preliminary results of review will be published in the FR, while the memorandum accompanying each notice that includes the background, methodology, and additional content will be adopted through the notice’s publication and posted on the IA Web site, available at http://ia.ita.doc.gov/frn/ext/”.

Aguilar of the U.S. Customs and Border Protection (CBP) announced the expansion of the Center of Excellence and Expertise (CEE) Centers.  These new Centers will be functional by the end of the Fiscal Year 2012.   According to the announcement, these two new Centers will be Automotive & Aerospace in Detroit, Michigan, and the Petroleum, Natural Gas & Minerals Center in Houston, Texas.

This expansion of more CEEs supports CBP’s focus on transforming customs procedures to align with modern business.  In the announcement, it was noted that CBP expects to establish five more Centers by the end of Fiscal Year 2013, bringing the number to nine.  Currently, there are two functioning CEEs – Electronics in Long Beach, California, and Pharmaceuticals, Health & Chemicals in New York City, New York.  Other possible centers that could come to fruition after the Automotive & Aerospace and Petroleum, Natural Gas & Minerals Centers are up and running, include:

  • Agriculture & Prepared Products
  • Base Metals & Machinery
  • Consumer Products & Mass Merchandising
  • Industrial & Manufacturing Materials
  • Textiles, Wearing Apparel & Footwear

Centers of Excellence & Expertise provide US importers/exporters with benefits such as fewer cargo delays, elimination of unnecessary paperwork/transactions, and creation of a single point of contact for inquiries.

During this COAC meeting the following subcommittees will provide reports:

  • Land Border Security
  • Trade Facilitation
  • One US Government at the Border
  • Role of the Broker

The COAC will also receive and update and discuss the following initiatives and subcommittee topics from the February 21, 2012 meeting:

  • The National Strategy for Global Supply Chain Security
  • The Automated Commercial Environment (ACE) and International Trade Data System (ITDS)
  • The Air Cargo Advance Screening (ACAS) pilot

The Four Step Process undertaken to achieve Mutual Recognition has been underway for a number of years and included a side-by-side comparison of program requirements, joint validations and the signing of the document on May 4th – the final step will be implementation.

What does this mean for the trade?  Benefits for certified businesses and traders for either the C-TPAT or EU AEO program include:

  • Reduced costs and time delays
  • Less red tape
  • Greater ease and predictability in the movement of goods
  • More access to new trade opportunities
  • Redundant validation visits eliminated
  • Single set of security standards
  • Simplified process  for companies to document that business partners meet minimum security requirements
  • Lower targeting score in CBP’s Advanced Targeting System (ATS) for AEO partners

For the Customs Administrations it means:

  • A unified vision
  • Compatibility with  security standards
  • Efficiency with reduced validations
  • Transparency in international commerce

The long-awaited US-EU Mutual Recognition Decision is the largest agreement of its kind that CBP has signed to date and includes all 27 EU member states.  The U.S. previously had Mutual Recognition Agreements with Canada, New Zealand, Jordon, Japan and S. Korea.  It is also currently working on completion of an Agreement with Singapore.
