Automated Export System (AES) Filing Mandate

Are your AES filings compliant?

 

US-based companies are now required to use the Automated Export System (AES) for exports. This has replaced the Shippers Export Declaration (SED) form. A review of the regulations that govern the Automated Export system are below.

  1. All companies exporting merchandise valued at $2,500 or more from the US to any foreign country must file an EEI using AES.
  2. All exports requiring an export license from the Commerce or State Departments require companies to file through AES.
  3. Even if companies rely on a freight-forwarder to file Electronic Export Information, the company is responsible for ensuring an accurate and timely filing takes place.
  4. The timeframe for filing export documentation varies based on the type of shipment (US Munitions List or non-US Munitions List) and by mode of transportation (vessel, air, truck, rail, mail or pipeline). These time frames vary from 1 hour prior to arrival at a US border to 24 hours prior to loading cargo at a US port.
  5. Companies are required to file using AES and may do so using an AES-certified software vendor, or develop software based on AES-recommended specifications.

In September 2008, the US Census Bureau mandated that all US exporters stop using the paper Shippers Export Declaration (SED) form and begin filing export information through the Automated Export System (AES). This meant that many companies had to find either a new way to file export documentation, or make sure that their freight forwarders were using the AES. Many companies chose to stop filing through a freight-forwarder and file on their own using AESDirect. Non-compliance could result in a hefty civil and criminal penalties for both the individual and the company.
