Export Control System for European Union member states

 

Beginning 1 July 2009, all European Union member states will need to file all export declarations electronically via their own national Customs Authority using a process known as the Export Control System (ECS). This new export ruling came into effect in April 2009 when the Commission of the European Union met and agreed upon Commission Regulations 273/2009.

Per this new ruling, all exports leaving an European Union (EU) member state must file all documentation — regardless of value, licensing or commodity — electronically. The Export Control System will facilitate trade between EU and other countries, allow Customs Authorities to gather more timely and accurate trade data, facilitate collection and/or refund of value added tax (VAT), and facilitate security and risk analysis. ECS will also act as a tool for more thorough and effective enforcement of export regulations for all EU member states.

The following key provisions govern the applicability of ECS:

  • Regulation 2913/92 provides the establishment of the obligation for economic operators to provide electronic entry and exit summary declarations to the Customs Authority for goods entering or leaving the customs territory of the Community
  • Regulation 1875/2006 states that this information is to be provided in an electronic format by all exporters by 1 July 2009
  • A transitional period (1 July 2009 to 31 December 2010) has been established for economic operators where they will able to, but not obliged, lodge electronic entry and exit summary declarations electronically
  • Under Regulation 2454/93, once this transitional period has ended, exporters who do not lodge electronic entry or exit summary declarations will delay Customs Authorities from carrying out risk analysis for safety and security purposes, and thus delay the exportation of their goods
